This notice describes how COMCHIM CHEMICAL S.R.L. processes personal data received through the website www.comchimchemical.ro, in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, or GDPR) and Romanian Law no. 190/2018.

COMCHIM CHEMICAL S.R.L. has not appointed a Data Protection Officer, as it does not fall within any of the situations set out in Article 37 GDPR. All requests and questions concerning personal data should be sent to comchimchemical@gmail.com or to the registered office indicated above.

1. What data we collect

Directly, only when you contact us through the form or by e-mail:

• first and last name;
• company and job title (optional);
• phone number;
• e-mail address;
• the message sent / the quote request / technical details.

We do not request special categories of data. We do not collect identity documents, bank account details or financial data through the website.

Automatically, when you access the website:

• IP address, browser type, device, pages visited (technical logs);
• cookies necessary for the operation of the website.

Providing your contact details through the form is neither a legal nor a contractual obligation, but it is necessary in order for us to respond to your request. Without this data, a quote request cannot be processed.

Please note that data collected automatically – the IP address and the identifiers stored in cookies – are considered personal data within the meaning of the GDPR and are treated as such, even though they do not allow the direct identification of an individual. They are pseudonymous, not anonymous.

2. Purposes of processing

We process data strictly for the following purposes:

• Commercial enquiries and quote requests – receiving, analysing and responding to enquiries regarding the products distributed by Comchim;
• Communication with visitors and customers – sending technical information, answering questions, product updates;
• Sending the requested quotes – preparing the commercial materials voluntarily requested by the user;
• Operation and security of the website – technical logs, server monitoring, prevention of abuse.

We do not use data for direct marketing purposes. We do not sell or rent personal data.

3. Legal basis for processing

Data is processed only where there is a legal justification:

• Article 6(1)(b) GDPR – steps taken at your request prior to entering into a contract (quote requests);
• Article 6(1)(a) GDPR – consent (voluntary submission of data);
• Article 6(1)(f) GDPR – legitimate interest: responding promptly to enquiries, operating the website, protecting our commercial activity.

We do not carry out automated profiling and we do not take automated decisions based on the data received.

4. Recipients of the data

• authorised Comchim personnel (responding to quote requests, commercial communication);
• IT and hosting providers, only where technically necessary;
• public authorities, exclusively on the basis of a legal obligation.

We do not transfer data to third parties for advertising purposes. There is no active newsletter and we do not build e-mail marketing lists from the contact form.

5. Where and how data is stored

Messages sent through the form or directly by e-mail arrive in the company official e-mail account listed on the Contact page. Storage takes place on Google infrastructure, which provides dedicated security and access protection mechanisms. Access to the mailbox is limited to authorised personnel.

There is no publicly accessible database. We do not synchronise data to an external CRM without consent.

Transfers outside the European Economic Area. The e-mail services used by COMCHIM CHEMICAL S.R.L. are provided by Google, and processing may involve a transfer of data to the United States of America. This transfer is carried out on the basis of the adequacy decision adopted by the European Commission on 10 July 2023 regarding the EU-US Data Privacy Framework and, where applicable, on the basis of the standard contractual clauses approved by the European Commission. We do not carry out any other transfers of data outside the European Economic Area.

6. Retention period

• Quote requests and questions sent through the website or by e-mail are kept only for as long as necessary for the communication and for a reasonable period of internal archiving, but no longer than 24 months from the last relevant interaction, unless they develop into a business relationship or a contract.
• Technical data (logs, website usage information) is kept for a limited period, strictly necessary to ensure the security and operation of the server, after which it is deleted or anonymised.

7. Your rights

Under the GDPR, you have the right to request at any time:

• access to the data we hold about you;
• rectification or updating of your data;
• erasure, the so-called right to be forgotten;
• restriction of processing;
• to object to processing based on legitimate interest;
• portability of the data you have provided voluntarily;
• withdrawal of consent at any time (this does not affect data processed previously).

Right to lodge a complaint. If you consider that we have infringed any of the rights above, you have the right to lodge a complaint with the Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP): B-dul G-ral. To exercise any of these rights, please write to us at comchimchemical@gmail.com. We will respond within one month of receiving your request, in accordance with Article 12(3) GDPR.

Ownership and copyright

The website www.comchimchemical.ro is owned and managed directly by COMCHIM CHEMICAL S.R.L. and is the only online property the company owns and through which it presents its services. Any other association or unauthorised presentation of company data does not bind COMCHIM CHEMICAL S.R.L. in any way towards any natural or legal person.

The information published on www.comchimchemical.ro belongs to COMCHIM CHEMICAL S.R.L. and may not be published, transmitted or copied by any means without the prior written consent of the legal representative of the company. Failure to comply is punishable under Law no. 8/1996 on copyright and related rights. Any copyright infringement can be reported to comchimchemical@gmail.com.
